Funding Server [LEGAL ENTITY NAME, STATE] ("Funding Server", "we") operates the Funding Server CRM at fundingserver.com (the "Service"), a private system used by independent brokerages and their processing partners to handle business-financing applications. This policy explains what information the Service holds, why, and how it is protected.
Who this applies to
- Authorized users — brokers, team leads, administrators, processors and accounting staff given an account.
- Merchants and business owners — businesses that applied for financing through a brokerage using the Service, and their owners/guarantors.
- Funders — financing companies that receive submissions.
Information we hold
- Business details: legal and trade names, EIN, addresses, industry, time in business, requested amount, revenue.
- Owner details: names, ownership percentage, contact details, home address, Social Security number and date of birth (needed by funders to underwrite).
- Documents the merchant or broker provides: applications, bank statements, IDs, voided checks, tax returns and similar.
- Communications: emails, texts and call notes between brokers and merchants, and between processors and funders.
- User account data: name, work email, role, sign-in times, IP addresses and an audit log of actions taken.
How we use it
- To prepare and submit financing applications the merchant requested, and to track offers and fundings.
- To let the merchant's brokerage follow up about the application, subject to contact preferences.
- To secure the Service, investigate misuse and meet legal obligations.
We do not sell personal information and we do not use it for advertising.
Sharing
- With the brokerage the merchant applied through, and with the processing companies and funders the application is submitted to.
- With service providers that host or operate the Service on our behalf under confidentiality obligations: [HOSTING PROVIDER], [OBJECT STORAGE PROVIDER], [TRANSACTIONAL EMAIL PROVIDER], [SMS/CALLING PROVIDER, IF ANY].
- When required by law, subpoena or to protect rights and safety.
Each brokerage's data is isolated from every other brokerage using the Service.
Security
- Encryption in transit (HTTPS only) and at rest; SSNs, dates of birth and EINs are additionally encrypted field by field and masked on screen.
- Two-factor authentication for every user, role-based access, session time-outs and account lockout.
- Documents are stored in private, encrypted storage and opened only through short-lived links after a permission check.
- An append-only audit log records sign-ins, sensitive-field reveals, edits, downloads, exports and deletions.
Contact preferences (calls, texts, email)
Merchants can opt out of calls, texts and marketing emails at any time by replying STOP to a text, using the unsubscribe link in an email, or asking their broker. Opt-outs and Do-Not-Call requests are enforced by the Service for every user. [ATTORNEY: confirm TCPA consent language used on applications.]
Retention
We keep application records for as long as needed for the purposes above and to meet legal, accounting and dispute-resolution requirements. Sensitive identifiers on inactive, unfunded applications can be cleared after a configurable period ([RETENTION PERIOD]).
